In Kenya, the process for recalling a Member of Parliament (MP) involves the following steps:
Grounds for Recall:
An MP can be recalled if they:
Violate the stipulations of Chapter Six of the Constitution.
Misuse public resources.
Initiating the Recall:
The recall process can only begin 24 months after the MP’s election and no later than 12 months before the next general election.
You cannot file a recall petition against an MP more than once during their term.
The petitioner must be a voter in the MP’s constituency and have voted in the election that brought the MP into power.
Filing the Petition:
The recall petition needs to be filed with the Independent Electoral and Boundaries Commission (IEBC) in writing.
The petitioner should specify the reasons for the recall and provide the names of voters in the constituency (at least 30% of registered voters).
